Center for Psychology of Creativity and Intellectual Property of the Research Institute of Intellectual Property of the National Academy of Legal Sciences of Ukraine was created in August 2017.

The purpose of the Center is to reveal legally significant aspects of the concept of “psychology of creativity” and the psychological foundation of the organization of intellectual activity of an individual as an integral part of the legal psychological phenomenon. The Center conducts research in the field of psychology of creativity and intellectual property.

The Center participates in events aimed at the disclosure of the phenomenon of creativity and intellectual property psychology. The Center carries out scientific research projects and participation in international research programs. The Center holds scientific discus and seminars.

The Center cooperates with international organizations, governmental and non-governmental organizations. Partners of the Center are the Institute of Psychology named after S.G. Kostyuk NAPS of Ukraine, international and non-governmental organizations.

  1. General Provisions.

Center for Psychology of Creativity and Intellectual Property of the Research Institute of Intellectual Property of the National Academy of Legal Sciences of Ukraine was founded in August 2017 with a view to developing a new scientific direction: “Legal and psychological phenomenon of creativity, scientific integrity and intellectual property”. The strategy of development of the scientific direction and its practical result will serve as the basis for educational programs, drafting and expert work.

  1. Current state.

The rights of individuals to creative activity are enshrined in Article 41 of the Constitution of Ukraine, which guarantees everyone the right to own, use and dispose of the results of their intellectual, creative activity, and Article 54 of the Constitution of Ukraine, which guarantees citizens the freedom of literary, artistic, scientific and technical creativity. Psychologists usually define “creativity” as the ability of a person to create ideas that are original and adapted. Instead, the interdisciplinary discourse on interpenetration and complementarity of law and psychology in the field of intellectual property is presented in the Ukrainian science severable.

  1. Purpose and objectives.

The purpose of the Center is to reveal legally significant aspects of the concept of “psychology of creativity” and the psychological foundation of the organization of intellectual activity of an individual as an integral part of the legal psychological phenomenon. Objective: to form an interdisciplinary discourse on representations of the psychology of creativity as a deliberate intellectual-mental activity, the result of which is the object of intellectual property. Identify legal and psychological factors that influence on the creation of intellectual property objects. To analyze approaches to the understanding of the nature of the psychology of creativity and its legally significant elements (psychogenetic, social, sensory-emotional, axiological, activity, motivational). To explore psychological categories in legal discourse. To develop psychological and legal criteria of awareness of the subject of creative activity of plagiarism. To provide legal analysis to creative thinking that leads to an independent intellectual product (object), by which we discover the legal criteria for unconscious borrowing. Plagiarism as a legal and psychological phenomenon. To investigate the influence collective knowledge on the formation of new scientific directions and discourses. To detecti and comprehend of legally significant elements of the psychology of creativity.

  1. The forms of realization of performing Concept.

Participation in events aimed at disclosing the phenomenon of psychology of creativity and intellectual property. Preparation of scientific research projects and participation in international research programs. Conducting scientific discus and seminars. Cooperation with international organizations, governmental and non-governmental organizations.

  1. Partners to implement the Concept.

Institute of Psychology named after S.G. Kostyuk NAPS of Ukraine, as well as scientific partners of the Concept’s implementation, are Ukrainian and international institutions and public organizations, whose sphere of activity and scientific interests include problems of creativity psychology and intellectual property rights.

  1. Final provisions.

The proposed Concept for the development of the scientific direction “Legal and psychological phenomenon of creativity, scientific integrity and intellectual property” of the Research Institute of Intellectual Property of the National Academy of Sciences of Ukraine is open to proposals. The provisions of the Concept and thematic areas are the intellectual property of the Research Institute of Intellectual Property of the National Academy of Sciences of Ukraine.
